Hungry Baby Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Hungry Baby ("we", "our", or "us"), including our web application at hungrybaby.app and our mobile applications for iOS and Android.

By creating an account, accessing, downloading, or using Hungry Baby, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms or the Privacy Policy, you must not use Hungry Baby.

2. About Hungry Baby

Hungry Baby is a shared infant care tracking application designed to help parents, legal guardians, and adult caregivers record, organize, and share baby care routines within a household.

The application allows households to record and synchronize care information such as feedings (nursing, bottles, and solids), pumping sessions, diaper changes, body weight measurements, and milk inventory across family devices.

3. Eligibility and Accounts

Hungry Baby is designed for parents, legal guardians, and caregivers. You must be legally capable of agreeing to these Terms to create an account and use the service.

When you create an account, you agree to:

• Provide accurate, current, and complete information, including a valid email address.
• Maintain the security and confidentiality of your login credentials.
• Accept responsibility for all activities, entries, and changes that occur under your account.
• Notify us promptly at support@hungrybaby.app if you detect or suspect any unauthorized access to your account or security incident.
• Use Hungry Baby only in compliance with all applicable local, state, national, and international laws.

4. Shared Households

Hungry Baby is built for collaborative family care. A user who creates a household acts as the initial household owner and may invite partners, family members, or caregivers to join the household by email.

When you invite caregivers to a household:

• Shared Visibility: All active members of the household can view child profiles, feeding timelines, pumping logs, diaper entries, weight measurements, milk stash inventory, and household settings.
• Caregiver Invitation Responsibility: You are solely responsible for deciding whom you invite into your household and ensuring you only grant access to people you trust with your family's care information.
• Household Ownership & Members: Household owners can add or rename child profiles, invite caregivers, cancel pending invitations, and remove members. If a household owner wishes to delete their account in a multi-caregiver household, the app requires transferring ownership or removing members first to ensure remaining caregivers do not lose access to the family's records.

Hungry Baby is a tracking and organizational tool only. It is NOT a medical device and does NOT provide medical advice, diagnosis, lactation consultation, or treatment.

All information presented in Hungry Baby (including feeding durations, quantities, derived milk volume estimates, feeding intervals, growth velocity statistics, weight trajectory charts, and diaper logs) is provided solely for your personal convenience and household coordination. It is not clinical data and must never be relied upon as a substitute for professional medical judgment.

• Always seek the advice of a qualified pediatrician, physician, lactation consultant, or healthcare provider with any questions or concerns you have regarding the health, nutrition, growth, or well-being of yourself or your child.
• Never disregard, delay, or substitute seeking professional medical advice because of information tracked or displayed in Hungry Baby.
• In an Emergency: If you believe you or your child are experiencing a medical emergency, call 911 (or your local emergency number) or go to the nearest emergency department immediately. Do not rely on Hungry Baby for emergency communication or urgent care decisions.

6. User Data & Privacy

Your privacy and the security of your family's care records are essential to us. Our collection, storage, and use of personal information are explained in our Privacy Policy.

Your use of Hungry Baby signifies that you have read, understood, and agreed to our Privacy Policy, which is incorporated by reference into these Terms.

7. User Content & Care Records

You retain full ownership of all data, timestamps, measurements, notes, child names, and care entries ("User Content") that you submit to Hungry Baby.

You grant Hungry Baby only the limited, non-exclusive, royalty-free, worldwide license strictly necessary to store, process, display, synchronize, transmit, and back up your User Content for the sole purpose of operating and providing the service to you and the members of your household.

Hungry Baby does not sell your family's care records or personal information. For detailed information regarding how we handle and protect your data, please review our Privacy Policy.

As described in Section 4, User Content you record within a household will be visible to other caregivers who belong to that household as necessary for shared caregiving.

8. Acceptable Use

You agree to use Hungry Baby only for personal, non-commercial family care tracking. You agree not to:

• Use the service for any unlawful, harassing, fraudulent, or malicious purpose.
• Attempt to gain unauthorized access to any other user's account, household, data, or systems.
• Interfere with, compromise, or disrupt the integrity, security, or performance of the service, backend servers, or connected networks.
• Circumvent, disable, probe, or tamper with security mechanisms, access controls, or rate limits.
• Use automated scrapers, bots, spiders, or extraction scripts in a manner that burdens, degrades, or overloads the service.

9. Account & Data Deletion

You can delete your Hungry Baby account or remove individual entries at any time through self-service controls in the application or by submitting a deletion request.

10. Service Availability & Changes

We are continuously working to improve Hungry Baby. We reserve the right to update, modify, expand, or discontinue features or portions of the service at any time.

While we make reasonable efforts to maintain reliable, high-quality operation, we cannot guarantee that the service will always be uninterrupted, timely, secure, or completely free of bugs, delays, or errors. We do not make commitments regarding guaranteed uptime percentages or support response times.

11. Third-Party Services & Platforms

Hungry Baby relies on third-party infrastructure and service providers to operate, including services for user authentication, cloud database hosting, and real-time data synchronization.

When accessing Hungry Baby through mobile applications downloaded from application marketplaces (such as Apple App Store or Google Play), your download, installation, and app-store interactions are also governed by the terms and conditions of the applicable platform operator.

12. Intellectual Property

The Hungry Baby application, branding, trademarks, logos, visual interface, icons, designs, documentation, and underlying software code are the exclusive property of Hungry Baby and its licensors and are protected by copyright, trademark, and other applicable intellectual property laws.

Nothing in these Terms grants Hungry Baby ownership of your User Content, and nothing in these Terms grants you any right to use Hungry Baby's trademarks, logos, or brand assets without prior written authorization.

13. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Hungry Baby is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.

We explicitly disclaim all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment, as well as any warranties arising out of course of dealing or usage of trade. We do not warrant that Hungry Baby will meet your specific requirements, that calculations or summaries will be error-free, or that defects will be corrected immediately.

14. Limitation of Liability

To the maximum extent permitted by applicable law, Hungry Baby, its developers, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to access or use the service;
• Any care decisions, feeding schedules, or actions taken or not taken based on information recorded or displayed in the app;
• Any unauthorized access, alteration, or loss of your transmissions, care records, or data; or
• Any bugs, viruses, or interruptions transmitted through the service.

Because Hungry Baby is an organizational logging tool for infant care, you expressly acknowledge that you remain solely responsible for the care, health, nourishment, and supervision of your child. Hungry Baby does not replace direct adult observation or medical care.

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties, so portions of the limitations above may not apply to you to the extent prohibited by law.

15. Termination

You are free to stop using Hungry Baby and delete your account at any time through the in-app settings or by contacting support.

We reserve the right to suspend or terminate your access to Hungry Baby if we reasonably determine that you have materially violated these Terms, engaged in fraudulent or unlawful behavior, or created a risk of harm or security threat to the service or other users.

16. Changes to These Terms

We may update these Terms from time to time as Hungry Baby evolves, new features are introduced, or legal standards change. When revisions are made, we will update the "Last Updated" date at the top of this page.

For material changes, we will provide reasonable advance notice through the application or website.

17. Governing Law

These Terms and any dispute, controversy, or claim arising out of or relating to Hungry Baby shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law principles, and subject to any mandatory consumer-protection provisions that apply in your jurisdiction.
